OK Folks, We are back at this again! Michael Byelick has decided to post more lies on his Web page against Avian Elites also known as http://www.avianelites.com and Melissa Lee.

We did not get ordered to take the website down. I had the site taken down as i no longer need it as i have retired from breeding. We do not have any other websites as he claimed we started under the name of Avianelites or any other name for that matter. Michael Byelick did not win his case and all proof will be added to this page. We are not moving to Anna Illinois as he also states.

Since Michael Byelick likes to tell lies, I have no other option then to start this page and let the facts/Court papers stand for themselves! We are also in the process of suing Michael again for his actions along with him not following the first order and taken the page against Avian Elites down.

You will see by the court papers posted below that we Avian Elites/Melissa Lee are the ones that won. We won $10,000 plus court fees and Michael Byelick was ordered to take the page down. We are in the process as well of getting what the courts ordered to us from Michael Byelick.

We will keep this page up and add all court papers and information that pertains to this case.

Just to make everyone aware, He is asking anyone and everyone to go ahead and reprint his page against us onto their sites. If this web page is copied and added to any other site this would be against the law. We have a court order to this effect and i will be more then happy to take all steps i need to in this matter.

A NEW POLICY & A WARNING

I am sorry to announce as of January 1, 2010, Avian Elites will no longer be accepting credit cards or Pay Pal for payment. I am very sorry for this action, but we have been scammed by 2 different individuals using credit card methods and through the Pay Pal website. I guess nowadays people are able to use credit cards, receive their items and then they are able to contact their credit card companies to stop the transactions. Thus, they keep their items and their money. So again, I am sorry, but the only way to protect my family is to stop accepting these payment methods altogether. We will still continue to accept postal money orders or cash when baby parrots, breeders or items are picked up.

I am also going to add the two persons names and information of the two that scammed us, so that everyone is aware to be very careful doing business with these folks. If they do this once, I guarantee they will do it again to someone else. If anyone else has been scammed by these people, please contact me as I do have more info that state laws do not allow me to post over the internet about these folks.

1st- Rory Thacker from E. University BLVD Dallas Texas - Rory Thacker purchased a few breeder pairs of parrots, paid using his credit card through Pay Pal. Received the pairs and then contacted his credit card company to cancel the transaction. Rory also uses Delta Airlines shipping into Dallas Fort Worth Airport.

2nd- Mike Byelick website- www.md-savannah-cats.com Email Address- mikeb@mdcigars.com Mike Byelick is from Yuma, Arizona 85367. Mike bought a Lyons Intensive Care Unit off of me, that he paid for by a credit card and through Pay Pal website. He claimed to his credit card company approximately a month after receiving the Intensive Care Unit that he never made the purchase at all. Luckily, I keep all emails for all transactions to prove he is a liar along with UPS shipping documents.***

Court papers were put in to Sangamon County, Illinois on March 10, 2010 Against Michael Byelick. Court date has been set for April 2nd, 2010. Michael was served on Friday 19th, 2010, Michael himself confirmed this by emailing me.

Ok, now that we have both been served, Im going to tell you now, I will use all my and my companies resources at my disposal to fight this BS suite from you, and go after you for damages and fees. I know copyright law and I know I will prevail as my website is not infringing. I have been involved in copyright issues before and own plenty of real copyrights. I will win.

This is the last chance I am going to give you to remove my name and personal info from your website. In turn I will remove the www.avainelites-scam.com website. Otherwise, I will win this suit, cost you court fees and other costs, and the website will stay up forever. I will not offer this again. My lawyer will be taking this over for me at this time should you decide keep this going.

No need to even respond to this email, if I see the info is still there next week then I know your answer and I will have my lawyer take over the rest of this case

UPDATE 6

Well we had our court date today 4/2/2010. Avian Elites/Melissa Won by default as Michael Byelick decided not to show up. We now have a $10,000 judgment against him along with a emergency order to have his web page taken down about Avian Elites/ Melissa. Avian Elites/ Melissa Lee will be adding a Lien against Michael Byelick on any assets he has or owns. Being we have a judgment against him, this will also go onto his credit record/report where Michael will not be able to buy a home, car or even get a loan until the amount is paid in full and we release the judgment through our courts.

UPDATE 7

Michael Byelick has refused to follow the court order here in Illinois on taken this website/page down against Avian Elites/Melissa Lee. Avian Elites has contacted Michael Byelick server (go daddy.com) to have this page removed along with faxing the court order to them. We can only suspect go daddy.com will follow the court order or my Attorney will follow up with court action against go daddy.com and Michael Byelick for not following court orders.
